'The problem of author's moral rights in conflict-of-laws'
The research addresses the problem of author's moral rights in cross-border disputes and the ultimate question of applicable law. The problems associated with application of 'lex loci protectionis' to cross-border infringement of author's moral rights supports carrying out an investigation concerning detachment of author's moral rights from copyright in conflict-of-laws. Therefore, this thesis examines this possibility and looks for the most suitable rule to be applied to author's moral rights in cross-border disputes without ignoring the differences between common and civil legal systems in approaching this problem.
Intellectual Property (IP) and Private international law (PIL) - specifically: copyright, author's moral rights and choice-of-law.
