Dr Jill Marshall’s paper investigates developments at the European Court of Human Rights to safeguard against gender based violence. Article 2’s right to life, Article 3’s absolute right to be free from torture, inhuman and degrading treatment, and Article 8’s right to respect for one’s private life have been interpreted by the Court so that everyone is now said to have a right to bodily and psychological integrity and autonomy. Dr Marshall examines the case law on this point which includes situations involving rape and other sexual and gender based violence by state agents and private individuals.
